General terms and conditions of sale

Article 1 – Scope of application

The present conditions of sale concern the products sold on the website www.editions-labutineuse.com and are applicable to the exclusion of all others. Orders are placed with :

Article 2 – Orders and withdrawal

Orders are placed on the website www.editions-labutineuse.com. To place an order, you must first have read and accepted these terms and conditions.

The fact of ticking the box “I accept the general terms and conditions of sale” present on the order basket certifies your unreserved consent to these GTC and to the special conditions.

In accordance with article L221-5 of the French Consumer Code, the customer has a period of fourteen clear days to exercise his right of withdrawal without having to provide any justification or suffer any penalties. The customer is then reimbursed (with the exception of the cost of returning the product, which remains at his expense).

Returns must be made in their original and complete condition, allowing them to be remarketed in new condition. In case of depreciation of the product, your responsibility may be engaged.

The customer is responsible for the return shipping costs. Reimbursement will be made after recovery of the goods, subject to their good condition, on the bank card that was used for the payment of the order.

Article 3 – Availability

Editions La Butineuse undertakes to reimburse any order that cannot be served but cannot pay any compensation for this.

Article 4 – Prices

Prices are indicated in euros, including all taxes (excluding preparation and shipping costs which depend on the shipping zone and are calculated before confirmation of the order), for France and all countries of the European Union. For the rest of the world, the books are sold tax-free and are subject to a customs declaration, with any import costs being borne by the customer.

Books are sold in strict compliance with French legislation on book prices, and in particular with the Loi Lang 81-766 of 10 August 1981 on the single price of books, which stipulates that it is the publisher who sets the price of the book, and that the bookseller may apply a discount to this price which may not exceed 5%.

Prices may be updated at any time without prior notice, but items are invoiced on the basis of the current price, displayed at the time the order is placed.

Article 5 – Payment

Orders are invoiced and payable in euros.

Any customs duties or local taxes for deliveries outside mainland France and the European Union are payable by the recipient. For shipments outside the European Union and DROM-COM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the Éditions La Butineuse.com website. They are the responsibility of the customer, both in terms of declarations and payments to the authorities and competent bodies of the country concerned.

The products delivered and invoiced remain the property of Éditions La Butineuse until full payment is received.

The preferred method of payment is by bank card (Visa, Eurocard, Mastercard). Only bank card payments can be used for the payment of digital books. 

Please contact us if you wish to pay by another means of payment for print books.

Article 6 – Payment security

Payment by credit card on the editions-labutineuse.com website is fully secured and encrypted by our Internet payment solution, Stripe. The sensitive information transmitted at the time of payment is subject to SSL encryption.

Following the transaction, the credit card number is stored or not, depending on your choice.

Article 7 – Pre-orders, publication dates and shipping

Editions La Butineuse offers the possibility of pre-ordering certain books before their publication. This allows us to print in a more virtuous way by adjusting the print run figures to demand.

The expected publication date of books that are not yet available is indicated on the product sheet. 

If the release date is not met, you will be notified by email and you will always have the option to cancel your order.

All orders for available books that reach us before noon are processed and shipped the same day.

In the event of a delay in shipment, you will be notified by email. In this case, and as long as the product has not been shipped, you can cancel your order.

Article 8 – Shipping costs and delivery times 

The delivery times for available books include the preparation time of the parcel plus the delivery time which depends on the geographical area of the customer. 

The table below shows you how your delivery time is calculated and the rates we offer by destination. 

Some countries restrict the entry of goods into their territory. It is the buyer’s responsibility to check the conditions of access to the items ordered in the destination country.

Editions La Butineuse cannot be held responsible for any destruction or blockage of the parcel on entry into the destination country.

The delivery times stated are the average times observed. The average delivery times for parcels are as follows:

 

Article 9 – Legal guarantee of conformity

 “Éditions La Butineuse SARL with a capital of €10,000 is liable for defects in the conformity of the goods to the contract under the conditions of article L. 211-4 et seq. of the French Consumer Code and for hidden defects in the goods sold under the conditions of articles 1641 et seq. of the French Civil Code.

In accordance with the provisions of the legal guarantees of conformity and hidden defects, we will refund you or exchange the apparently defective products. In this case, we thank you for contacting us by email (contact section) indicated in the order confirmation email.

The products must be returned in packaging that allows for transport in good conditions. The shipping costs will be reimbursed on the basis of the invoiced rate and the return costs will be reimbursed to you on presentation of the receipts.

It is reminded that within the framework of the legal guarantee of conformity, the consumer :

– has a period of two years from the date of delivery of the goods to take action against the seller;

– may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code;

– is exempted from proving the existence of a lack of conformity of the goods during the 24 months following delivery of the goods (for second-hand goods, this period is 6 months).

The legal guarantee of conformity applies independently of the commercial guarantee that may cover your goods. It is recalled that the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 2.

Article 10 – Disputes

In the event of a dispute, French law shall apply.

In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. The mediator must be contacted within one year of the initial complaint.

Special conditions for the sale of digital items (ebooks)

Article 1. Special conditions for the sale of digital items (ebooks)

In order to be authorised to place an order for ebooks on www.editions-labutineuse.com , you must first have read and accepted these terms and conditions.

The terms and conditions for downloading, reading and the general technical constraints associated with downloading digital files are presented below 

Éditions La Butineuse sells digital books (eBooks) in PDF and ePuB format. Opening digital books requires specific reading software, which must first be installed on the computer or mobile reading device (tablet or smartphone). One widely used reading software is that distributed by the company Adobe: Adobe Digital Editions.

The characteristics of the two formats offered are as follows:

PDF format: standard digital reading format for ebooks created by the company Adobe Systems. It preserves the formatting as defined by the publisher. 

ePub format: standard digital reading format recommended by the IDPF (International Digital Publishing Forum). It allows dynamic pagination.

There are many software and applications available to read these files, which are often installed natively on computers and mobile terminals.

These two formats are compatible with e-readers such as Bookeen, Kobo, Nook, Pocketbook and Sony. They are not compatible with Kindle e-readers, a brand owned by Amazon.

These terms and conditions and general technical constraints are presumed to be known and accepted at the time of ordering. Under no circumstances may a claim or request for reimbursement be made on the basis of ignorance or refusal of these general technical terms and conditions.

Article 2. Ordering, payment and delivery process

You agree to provide true and sincere information.

Once you have provided the requested information, you check the box “I accept the general terms and conditions of sale”. By checking this box, you agree to these terms and conditions, including the general technical terms and conditions related to the purchase of the digital item files presented on the digital item service’s instructions and help pages and the terms of use related to each product (in particular the file formats, protection conditions and usage rights).

You may abandon your order until payment has been confirmed.

The payment of an order for digital books cannot be made by any other means of payment than credit card. When paying, you will be taken to a secure page where you will be asked to enter your credit card number, its expiry date and the number on the back of the card (visual cryptogram). Your credit card number is encrypted for added security when it is transferred. Following the transaction, the credit card number is stored or not, depending on your choice.

Once the credit card code has been entered, the order is confirmed and can no longer be cancelled or refunded.

After validation of your order on www.editions-labutineuse.com, you will receive an e-mail confirming your order at the e-mail address associated with your customer account. This e-mail contains a link to a download page for the digital files ordered. The sending of this e-mail is an acknowledgement of receipt of your order. Access to the purchased files is available to you on a personal basis only and remains valid for a period of time depending on the type of file format of the digital items ordered, starting from the moment the order is registered.

Once you have received the download links or the online playback links for the digital files ordered, you have no possibility of cancelling your order and the price of your purchase will be automatically debited, even if you subsequently decide not to download the said files.

As soon as the download links are sent, orders for digital files are deemed to be firm and definitive and cannot give rise to any exchange or refund.

You acknowledge that the fourteen-day cooling-off period provided for in Article L.221-5 of the French Consumer Code does not apply once the order has been fulfilled by sending the download links, which are equivalent to a final delivery of the product, in accordance with Article L.221-28 of the French Consumer Code.

In case of difficulties, and in particular if you do not receive the download or reading links on the e-mail address associated with your customer account, you can contact the customer service of Editions La Butineuse using the contact form.

Article 3. Prices

The prices expressed on the digital items service are inclusive of all taxes. The communication costs related to the access to and use of the Digital Items download site and the Digital Items service remain at your charge.

The prices of the digital books are quoted in euros including all taxes. The price of digital books is established in strict compliance with the law n° 2011-590 of 26 May 2011 on the price of digital books.

Editions La Butineuse reserves the right to modify its prices at any time, but digital books will be invoiced on the basis of the rates in force at the time the order is registered.

Article 4. Proof

In the absence of proof to the contrary, the data recorded on the digital items bookshop constitutes proof of all the orders you have placed.

Article 5. Protection of copyrights

The digital files ordered, their content, as well as all the elements reproduced on the digital item download site as part of this service (in particular texts, comments, illustrations and iconographic documents) are protected by the Intellectual Property Code in France and by foreign legislation governing copyright and related rights, trademark law, design law and patent law.

As such, the intellectual works presented and offered for downloading and reading are only intended for strictly personal, private and free use. Any reproduction, adaptation or representation in any form and by any means whatsoever, and in particular the resale, exchange, rental or transfer to a third party, are absolutely prohibited.

The files of the digital items offered on the digital item library are protected by technical protection measures or Digital Rights Management systems, i.e. protection systems that make it possible to control their use and in particular their copying. Their purpose is to offer the customer maximum flexibility in the use of the downloaded recordings while protecting the rights of the authors, performers and publishers of the works. The customer undertakes not to circumvent or undermine the technical measures for controlling the use of the downloaded digital files or any device with the same objective.

These technical protection measures are governed by the Law n° 2006-961 of 1st August 2006 relating to copyright and related rights in the information society. Any attempt to circumvent these measures is subject to the penalties provided for by this law. More generally, any use outside the framework defined in the present general terms and conditions would be considered as an act of counterfeiting, which exposes the customer to legal, civil or criminal proceedings within the framework of the legislative and regulatory provisions in force.

Article 6. Responsibility

Editions La Butineuse cannot be held responsible for the limits of the Internet network and in particular for its technical performance and response times for consulting, querying or transferring data. Furthermore, it is your responsibility to take all appropriate measures to protect your own data and software from contamination by any computer “virus”.

In some countries, the laws in force prohibit or restrict free access to certain intellectual works; you undertake to check that, with regard to the law of the place of order, there are no similar prohibitions or restrictions concerning the digital files ordered.

Editions La Butineuse cannot be held responsible for any malfunction occurring at the time of downloading the digital files ordered and which is not their fault.
